Public Terms of Use
These Public Terms of Use apply to everyone who uses BookMediFly — individuals, families, hospitals, case managers, providers, visitors, and quote requesters. If you are an operator or affiliate organization, you are also subject to the separate Affiliate Partner Terms.
1. Acceptance of Terms
By accessing or using BookMediFly.com and related services (the "Platform," operated by BookMediFly / MediFly LLC, "BookMediFly," "we," "us," or "our"), you agree to these Public Terms of Use ("Terms"). These Terms apply to all visitors, quote requesters, individuals, families, hospitals, case managers, and providers who access or use the Platform. If you do not agree, please discontinue use of the Platform. Operators and affiliate organizations are additionally governed by the separate Affiliate Partner Terms.
2. What BookMediFly Does
BookMediFly is an online software marketplace and coordination platform that helps individuals, families, and providers connect with participating air medical transport operators ("affiliate partners" or "participating operators") to request and compare quotes for scheduled fixed-wing medical transport. We provide software that facilitates communication, quote requests, and quote comparison between requesters and participating operators.
- An Individual is a patient, family member, guardian, or representative arranging transport for themselves or another person.
- A Provider is a hospital, clinic, medical facility, case manager, or agency coordinating transport on behalf of a patient.
- An Affiliate Partner / Participating Operator is an independent air medical or medical transport company that operates flights, vehicles, or related services and participates on the Platform under the separate Affiliate Partner Terms.
3. What BookMediFly Does Not Do
BookMediFly is a software marketplace and coordination platform only. We do not, and these Terms must not be read to suggest that we:
- own, manage, control, operate, or crew any aircraft, vehicle, or medical equipment;
- provide medical transport services of any kind;
- provide medical advice, diagnosis, treatment, triage, or patient assessment, or evaluate clinical fitness for transport;
- provide emergency dispatch, 911 or equivalent emergency response service, helicopter dispatch, or any emergency response service;
- act as a broker, insurer, payment processor, escrow agent, or healthcare provider;
- certify, guarantee, endorse, or warrant any operator, or the safety or outcome of any service.
Any reference to operator licensing, insurance, accreditation, or capability is based on operator-submitted documentation that we make reasonable efforts to review; we do not guarantee its accuracy or ongoing validity.
4. No Guarantees
BookMediFly does not guarantee:
- that any participating operator will be available for a given route, date, or medical need;
- that you will receive a response, or more than one response, to any quote request;
- that any quote reflects the lowest available price;
- that any booking will be made or completed.
Quote requests are invitations for participating operators to respond at their discretion. The Platform connects parties; it does not promise an outcome.
5. Emergency Disclaimer
Do not use BookMediFly for life-threatening emergencies. For immediate medical emergencies, call your local emergency services (911 in the US, 999 in the UK, 112 in the EU) or go directly to the nearest emergency room. BookMediFly is not an emergency dispatch or emergency response service.
6. Your Account & Responsibilities
When you create an account, you must provide information that is accurate, complete, and current. You are responsible for safeguarding your password and credentials, for all activity under your account, for not disclosing your password, and for notifying us immediately at support@bookmedifly.com upon any suspected breach or unauthorized use. BookMediFly is not liable for loss or damage arising from your failure to meet these obligations.
7. Your Authority to Submit a Request
You represent that you are at least 18 years old, that all information you provide is accurate and truthful, and that when coordinating for another person you have full authority to act on their behalf. You are responsible for confirming that any chosen operator meets your safety, medical, and logistical requirements.
8. No Protected Health Information (PHI)
The Platform is not intended for the transmission or storage of protected health information. You must not submit patient-identifiable information through the Platform, including (without limitation) patient names, medical record numbers, Social Security numbers, insurance member numbers, diagnoses, treatment plans, dates of birth, or any of the 18 HIPAA-defined identifiers.
Provide only the basic contact and trip details needed to coordinate a quote request. If you believe PHI has been inadvertently submitted, contact us immediately at support@bookmedifly.com so we can take appropriate action.
9. Contact & Trip-Detail Handling
We collect the contact and trip details you provide so that participating operators can review and respond to quote requests. Your information is handled in accordance with our Privacy Policy. We do not sell your personal information.
10. Quote Requests & Responses
Quotes, including pricing, validity periods, inclusions, exclusions, and payment terms, are set entirely by the participating operator that issues them. BookMediFly does not set, negotiate, or guarantee pricing and does not control whether or how quickly an operator responds. Operator-issued quotes and any operator-provided documents control the terms of any potential transport.
Operator responses vary. One or more operators may respond, but a response is not guaranteed, multiple quotes are not guaranteed, and the lowest available price is not guaranteed. Any quote request window shown on the Platform (for example, a 45-day quote request window) supports coordination only and is not a guarantee that an operator's price will remain valid for that period; price validity, availability, inclusions, exclusions, and payment terms are controlled by the operator's submitted quote terms.
Quotes and any operator-provided documents may contain pricing or operational information supplied by participating operators. You are responsible for how you use or share quote materials after you receive them, and BookMediFly does not guarantee that quote materials shared outside the Platform will remain confidential.
11. Direct Relationship With the Operator
Any agreement for transport is directly between you and the participating operator. Operators are independent contractors and are not employees, partners, agents, or joint venturers of BookMediFly. BookMediFly is not a party to any agreement between you and an operator and does not supervise, direct, or guarantee any service.
12. Payments
BookMediFly does not collect or process payments for transport on behalf of operators. All payment, contracting, refunds, and disputes for transport occur directly between you and the operator. BookMediFly is not a payment processor, broker, or escrow agent for transport services.
13. Cancellations, Delays & Operational Changes
All cancellations, delays, diversions, reroutings, and operational changes are governed by the operator's own policies. BookMediFly is not responsible for flight delays, cancellations, or diversions; medical emergencies, injuries, or deaths before, during, or after transport; emergency landings or operational disruptions; or losses arising from force majeure events such as natural disasters, government action, strikes, or war.
14. Third-Party Service Providers
BookMediFly uses trusted third-party providers to support Platform operations (for example, email delivery, SMS messaging, cloud data storage, and bot/fraud/security verification). By using the Platform, you acknowledge that certain data may be processed by these providers under their own terms. We select providers that maintain appropriate security standards but are not responsible for their individual terms or practices. See our Privacy Policy for details.
15. Data Handling & Security
BookMediFly is a coordination platform that collects the contact and trip details needed to coordinate quote requests. While we implement reasonable safeguards, no system is completely immune from disruption. In the event of a security incident or service interruption, we will take commercially reasonable steps to investigate, mitigate impact, and restore availability, and we maintain backup and recovery procedures designed to support continuity. See §8 (No PHI) for your responsibilities regarding sensitive data.
16. Service Availability
We reserve the right at any time to modify, suspend, or discontinue the Platform (or any part, feature, or content) with or without notice, and we will not be liable for any such modification, suspension, or discontinuance. For time-critical needs, you should maintain direct contact information for your preferred operators as a backup communication channel.
17. Prohibited Uses
You may not use the Platform: for any unlawful purpose or to solicit unlawful acts; to violate any applicable laws or regulations; to infringe intellectual property rights; to harass, abuse, defame, or discriminate; to submit false, misleading, or fraudulent information; to upload malicious code; to collect or harvest other users' personal information; to spam, phish, scrape, or use automated tools without permission; to interfere with or circumvent Platform security; to misrepresent your identity or authority; to circumvent booking relationships established through the Platform; or to misuse operator quote materials to misrepresent pricing, impersonate operators, or interfere with Platform integrity. We may suspend or terminate access for any prohibited use.
18. Intellectual Property
All content on BookMediFly.com — including text, graphics, logos, and design — is the property of BookMediFly or its licensors. You may not reproduce, duplicate, copy, sell, resell, modify, or distribute any content or exploit any portion of the Platform without our prior written consent.
19. Disclaimer of Warranties
All content and services provided by BookMediFly are offered "as is" and "as available." We make reasonable efforts to review operator documentation but do not guarantee that operator licensing, insurance, or accreditation information is accurate, current, or free from misrepresentation. We disclaim all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
20. Limitation of Liability
To the maximum extent permitted by law: BookMediFly's total aggregate liability for any claim shall not exceed the amount (if any) you paid directly to BookMediFly for use of the Platform; BookMediFly shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages (including lost profits, lost data, emotional distress, or reputational harm); and this limitation applies whether based in contract, tort, strict liability, or otherwise, even if advised of the possibility of such damages. Where a jurisdiction does not allow certain limitations, our liability is limited to the maximum extent permitted by law.
To the fullest extent permitted by law, BookMediFly follows the standard limitation model used by online marketplaces and travel platforms: it is not a guarantor or insurer of any service or outcome, assumes no liability for loss, accident, damage, or injury connected to operator services, and does not endorse, warrant, or certify any operator. By using the Platform, you release BookMediFly from liability arising out of or connected to your transport or medical arrangements.
21. Indemnification
You agree to indemnify, defend, and hold harmless BookMediFly and its owners, affiliates, officers, directors, agents, contractors, service providers, and employees from any claim, demand, loss, damage, liability, or expense (including reasonable attorney fees) arising from your breach of these Terms, your use of the Platform, your dealings with any operator or provider, your violation of any law or third-party right, or any injury, loss, or damage resulting from transport or coordination services.
22. Governing Law
These Terms are governed by the laws of the jurisdiction in which BookMediFly / MediFly LLC is registered, without regard to conflict-of-law provisions, except where applicable law requires otherwise. Claims or disputes shall be brought before the competent courts or arbitration venues of the applicable jurisdiction.
23. Updates to These Terms
We may modify or replace these Terms at our discretion. If a revision is material, we will endeavor to provide at least 30 days' notice prior to the new terms taking effect; what constitutes a material change is at our discretion. Updates are posted with a new effective/"Last Updated" date. Continuing to use the Platform after revisions take effect constitutes acceptance.
24. Privacy
Your use of the Platform is also governed by our Privacy Policy, which describes how we collect and use information. By using the Platform, you consent to that collection and use.
25. Severability & Entire Agreement
If any provision is found unlawful, void, or unenforceable, it shall be severed and the remaining provisions remain in effect. These Terms (together with the Privacy Policy and any posted policies) constitute the entire agreement governing your use of the Platform and supersede prior agreements. Our failure to enforce any provision is not a waiver.
